RENEWAL AFTER ARRAIGO

🧾 RENEWAL AFTER ARRAIGO

If you currently hold a temporary residence permit that allows you to work — such as Arraigo Sociolaboral, Arraigo Familiar, Arraigo por Formación, or any other exceptional circumstance permit — and you’ve been living in Spain for at least one year, this is your next step. 🎉

It’s time to modify your residence into a regular residence and work permit valid for 4 years, giving you full legal stability and freedom to work in Spain. 🇪🇸

💡 What Is This Procedure?

This process is officially called:

“Modification from a temporary residence that allows work to a residence and work authorization (initial)”

In simple words:

➡️ It’s the first renewal after your arraigo or exceptional residence.
➡️ It transforms your permit into a 4-year residence and work authorization.
➡️ You’ll now have a standard, stable residence status in Spain.

✅ Who Can Apply?

You can apply if:

  • You’ve held a temporary residence that allows work for at least 1 year.

  • You continue to live legally and continuously in Spain.

  • You have no criminal record in Spain or in any country you’ve lived in during the last 5 years.

Then, depending on your situation, you can apply as an employee (por cuenta ajena) or self-employed (por cuenta propia).

👷 If You Work as an Employee (Por Cuenta Ajena)

You can apply if you meet one of these situations:

  • You continue working for the same employer who sponsored your initial permit.

  • You have worked for at least 3 months per year and meet one of these:

    • You now have a new valid work contract, or

    • You are receiving unemployment benefits, or

    • You are registered as a job seeker (demandante de empleo).

  • You have worked at least 9 months in the last 12 months (even with gaps).

  • You have a family member in Spain (as defined in Article 66) who meets financial requirements to support you.

  • Your contract ended because you are a victim of gender or sexual violence.

💼 About the work contract:

  • If its a new work contract, the contract must be signed by a company in Spain and start once your new permit is approved.

  • If your work contract is with the same employer you had when you applied for your Arraigo Sociolaboral, you don’t need to present a new one — the important thing is that you are still registered and active in Social Security.

  • It must be Indefinido (not temporary or sporadic).

  • It can be part-time or full-time, but the total annual salary must be equal to or higher than the Spanish Minimum Wage (SMI) for a full-time job.

💡 If You Work as Self-Employed (Por Cuenta Propia)

You can apply if you:

  • Continue your same autónomo activity, meeting all tax and Social Security obligations.

  • Are receiving unemployment or cessation of activity benefits.

  • Had to stop your activity for reasons beyond your control.

  • Have a family member who meets the financial conditions to support you.

  • Are a victim of gender or sexual violence.

📋 Documents You Need

We’ll prepare everything for you — but in general, you’ll need:

  • Full passport (all pages, valid).

  • NIE card (front and back).

  • Proof of employment or activity, depending on your case:

    • Current or new work contract (meeting the conditions above).

    • Proof of past work and job-seeking registration.

    • Proof of unemployment benefits (if applicable).

    • Proof of self-employment and tax payments (if autónomo).

  • Recent padrón certificate.

  • School certificate if you have children in school age.

  • Payment of government fees:

    • Tasa 790–052 (section 2.5.2) – for residence modification (included in our service).

    • Tasa 790–062 (section 3.2.2) – for the work authorization (must be paid by the employer).

💡 We prepare both taxes — the 052 is included in our service, and the 062 must be paid directly by your employer.

📅 How Long Is the New Permit Valid?

Once approved, your new residence and work authorization will be valid for 4 years.

It gives you full freedom to live and work legally in Spain without yearly renewals. 🇪🇸

⏳ How Long Does It Take?

The Immigration Office has up to 3 months to decide.

✅ If you don’t receive a response within 3 months, your application is considered approved automatically (positive silence).

After approval:

  • You (or your employer) must register you in Social Security within 1 month.

  • Then you must apply for your new TIE card (fingerprints) at the police station within another month.
